About Form I-9 — Employment Eligibility Verification
Form I-9 is required by federal law for every person hired to work in the United States — citizens and noncitizens alike. The employee completes Section 1 on or before their first day of work, certifying their identity and work authorization status. The employer completes Section 2 within 3 business days, physically examining original documents from the Lists of Acceptable Documents (List A alone, or List B plus List C). Employers must retain I-9s for 3 years after the hire date or 1 year after termination, whichever is later, and must make them available for inspection by DHS, ICE, or DOL. Remote hires may use an authorized representative to complete the physical document inspection.
