An EEOC charge of discrimination is a signed statement filed with the Equal Employment Opportunity Commission (EEOC) alleging that an employer, union, or employment agency violated one of the laws the EEOC enforces β including Title VII (race, color, religion, sex, national origin), ADA (disability), ADEA (age 40+), or EPA (pay equity). Filing an EEOC charge is generally a prerequisite to filing a private discrimination lawsuit in federal court. Charges must be filed within 180 days of the discriminatory act (or 300 days in states with their own fair employment agencies). The EEOC will notify the employer, investigate, attempt mediation, and either resolve the charge or issue a 'Right to Sue' letter.
