Form I-864 (Affidavit of Support) is a legally binding contract where a U.S. citizen or permanent resident sponsor agrees to financially support an immigrant at a level at or above 125% of the federal poverty guidelines. It is required for most family-based green card applications and some employment-based cases. By signing Form I-864, the sponsor accepts legal responsibility for the immigrant until they become a U.S. citizen, earn 40 qualifying Social Security credits, permanently leave the US, or die. The obligation is legally enforceable — if the sponsored immigrant receives certain public benefits, the government can sue the sponsor for reimbursement.
