Form I-751 is filed by conditional permanent residents who obtained their green card through marriage to a U.S. citizen or permanent resident. A conditional green card is valid for only 2 years. To remove the conditions and obtain a 10-year permanent green card, you must jointly file I-751 with your spouse within the 90-day window before the card expires. If the marriage has ended in good faith divorce, or if you have been subject to battery or extreme cruelty, you may file I-751 as a waiver without your spouse. USCIS will issue a Notice of Action extending your conditional status by 24 months while the petition is pending.
