About Form 8832 — Entity Classification Election
Form 8832 (Entity Classification Election) is filed by eligible business entities — including LLCs, foreign entities, and certain other organizations — to choose how they want to be classified for U.S. federal tax purposes. By default, a single-member LLC is taxed as a disregarded entity (sole proprietorship), and a multi-member LLC is taxed as a partnership. Form 8832 allows these entities to elect to be taxed as a C corporation instead. The election generally takes effect on the date specified on the form (up to 75 days prior or 12 months after filing). This form is separate from Form 2553, which is used specifically for S corporation elections.
